Public Offer / User Agreement

This Public Offer governs the use of the ClarityON website and the purchase of digital products — Google Sheets templates (the “Products”). By placing an order you confirm that you accept these terms.

This Agreement constitutes a public offer under EU consumer law and defines the terms for purchasing digital products from ClarityON via Gumroad.

1. Parties and Details

Seller / Rightsholder: Igor Balanetchii, residing in Verona, Italy (the “Seller”).

Payment provider: Gumroad, Inc. — payment processing and digital content delivery.

2. Subject of the Agreement

The Seller grants the Buyer a non-exclusive, non-transferable license to use the purchased digital Product for the Buyer’s personal purposes, as set out in Section 6.

3. Ordering and Payment

Orders and payments are made via Gumroad widgets/pages integrated on the website.
Prices are shown in the displayed currency; applicable taxes (such as VAT) are calculated and handled by Gumroad according to law.
The Seller does not process or store payment credentials; payments are securely handled by Gumroad on their platform.

4. Delivery and Access

After successful payment, the Buyer receives instant access to the Product: a link to copy/open a Google Sheet or another digital file/link.
Access details are sent to the email provided at checkout and/or available on the Gumroad “Downloads” page.

5. Refunds and Cancellations

The Products are digital content. Refunds are generally not provided once access has been granted or the Product has been downloaded.
Exceptions may apply in cases of duplicate payment or verified technical issues preventing access. Requests must be sent within 14 days of the transaction to clarityon.official@gmail.com.
Gumroad’s refund policy and consumer protection obligations apply with respect to payment procedures.

6. License and Permitted Use

License: personal, non-exclusive, non-transferable, perpetual use of the Product by the Buyer.
Prohibited: resale, redistribution, sharing with third parties, publishing source files, or including the Product in commercial packages or courses without written permission.
Allowed: personal use, making a duplicate copy in your Google Drive, and non-commercial use within your family/team (up to 5 people), unless otherwise stated on the product page.

7. Intellectual Property

All intellectual property rights to the Products and website materials remain with the Seller. No rights are assigned except for the limited license granted herein.

8. Obligations of the Parties

Seller: provides access to the Product after payment and offers reasonable technical support for installation/initial setup.
Buyer: provides accurate information at purchase and complies with these terms of use.

9. Limitation of Liability

Products are provided “as is”. The Seller does not guarantee achievement of specific results and is not liable for lost profits or indirect damages.
The Seller’s total liability is limited to the amount actually paid for the respective Product.

10. Support

For installation or access questions, contact support at clarityon.official@gmail.com. Typical response time is up to 48 business hours.

11. Personal Data

Personal data processing is governed by our Privacy Policy. Payment data is processed securely by Gumroad, Inc.

12. Governing Law and Disputes

This Offer is governed by the law of an EU Member State (GDPR applies). Disputes should first be resolved amicably; if unresolved, they are subject to the competent court at the Seller’s place of residence — Verona, Italy.

13. Changes to the Offer

We may update these terms from time to time. The current version is always available at this address and applies to purchases made from the date of publication.
